hak pakai
a right-of-use title on a completed structure, registered at the land office in the foreign buyer's own name — instrument D of the strategy.
the titled channel: where A and B are contracts with PT PMA, hak pakai is a registered right — the strongest form a foreign individual can hold in Indonesia in their own name. it applies to built assets — a finished, certified villa — not raw land; the underlying parcel stays with PT PMA. payment 100% at transfer.
what it takes:
- a residence permit (KITAS/KITAP) in the buyer's name
- a completed structure with its building certificates — hak pakai does not attach to empty ground here
- statutory term cycles with extensions under Indonesian land law (PP 18/2021)
for whom: buyers who want a registered title rather than a contract, and hold or plan to hold Indonesian residency.
